Definition

Clearance under India's Emigration Act, 1983, required for ECR-category passport holders going to work in 18 notified countries, mostly in the Gulf. Travellers also loosely call the departure immigration counter at Indian airports 'emigration'.

Two meanings, one word

In everyday use, emigration means the passport counter you pass when leaving India. Officially it's narrower: emigration clearance is permission from the Protector of Emigrants, issued through the eMigrate system, for Indian workers with an Emigration Check Required (ECR) passport taking up jobs in notified countries.

Who has an ECR passport

Passports of Indians who haven't passed Class 10, and don't fall into another exempt category, are endorsed ECR. Everyone else is ECNR (Emigration Check Not Required), and newer ECNR passports simply carry no endorsement. See ECR and ECNR.

The 18 ECR countries are Afghanistan, Bahrain, Indonesia, Iraq, Jordan, Kuwait, Lebanon, Libya, Malaysia, Oman, Qatar, Saudi Arabia, South Sudan, Sudan, Syria, Thailand, the UAE and Yemen.

ECR holders on holiday

Emigration clearance is for employment. An ECR passport holder going to Dubai on a tourist visa doesn't need it, but should carry:

  • A valid visit visa, not an employment visa
  • A confirmed return ticket
  • Hotel bookings, or an invitation and ID copy from the relative they're visiting

Immigration officers at Indian airports may question ECR holders on Gulf visit visas closely, because people lured by fake job offers often travel on visit visas.

An example

A 38-year-old from Gorakhpur who left school after Class 8 flies to Dubai to visit his brother. His passport is ECR. He doesn't need emigration clearance, but he carries his UAE visit visa, return ticket and a copy of his brother's Emirates ID and tenancy contract. The officer's questions take a minute.

To remove the ECR endorsement, apply for a passport reissue with your Class 10 certificate or proof of another exempt category, such as being over 50.
